Terms of Use and Waiver of Liability 

This Agreement is entered into by and between Guest(s) and Park (for reservations at the Sullivan, Missouri location, “Park” is Biermann and Turntine Properties, LLC; for reservations at the Kingsland, Georgia location, “Park” is RV Self-Park #2, LLC).  Guest hereby agrees to comply with all of the terms and conditions set forth herein.

1. Park Rules.  Guests shall abide by all Park Rules at all times.  Park Rules are posted on rvselfpark.com and are hereby included as an integral part of this Agreement. Failure of Guest, or Guest’s guests, visitors, or invitees, to abide by all Park Rules can cause early and immediate termination of this Agreement at Park’s sole discretion. Park reserves the right to update the rules on rvselfpark.com from time-to-time, and Guest understands and agrees that any changes to the Park Rules on rvselfpark.com shall be immediately effective.

2. Guest Obligations 

A. Payment In Advance For Utilization of Parking Site. Guest shall pay to Park a utilization charge in the amount determined by Guest’s chosen reserved amount of parking time and as calculated upon entry of the reservation details by the Guest (“Utilization Charge”) at or prior to the time of making a reservation.   Each such Utilization Charge shall be made by Guest electronically and will incur an additional electronic transaction fee, a non-refundable PayPal transaction fee and any applicable local or state tax. 

B. Holding Over. If Guest retains possession of a parking site, or any part thereof, after the expiration or termination of the reserved parking time, Park is authorized to immediately terminate all utilities, and Guest shall become immediately obligated to make hourly Utilization Charge payments to the Park at the hourly rate of ten dollars ($10.00). After the first hour, Park may at its option increase the Utilization Charge by an additional ten dollars ($10.00) for each additional hour Guest remains in possession after the expiration of the original time period of Utilization.  If the Hold Over parking space is reserved for another incoming Guest, Park may have Guest vehicle(s) removed and stored at the Guest’s expense. In addition, thereto, Guest shall pay Park for all damages, consequential as well as direct, as may be sustained by Park due to Guest's retention of possession beyond the original time period of Utilization, including but not limited to a reasonable administrative fee in the minimum amount of $100 in the event that law enforcement or a towing service is called in connection with the holding over. The provisions of this Section do not exclude Park's rights of re-entry or any other rights thereunder. No such holding over shall be deemed to constitute a renewal or extension of the Guest’s right under this Agreement to the Utilization of a parking site. 

C. Guest Responsibilities. Guest agrees that he or she is responsible for Guest’s actions and those of Guest’s guests, visitors, invitees, licensees, or pets, whether registered or not, and that all will follow all laws, Park Rules, and policies of Park while utilizing the parking space and while in the Park.  

D. Indemnity and Waiver of Liability. Guest agrees to indemnify, defend and hold harmless Park along with Park’s employees, from and against, any and all liability and/or claims whatsoever, for personal injury, bodily injury, death, and/or property damage or property loss, resulting from Guest’s visit to Park and or use of parking space, or due to actions or conduct of Guest’s guests, visitors, invitees, licensees, or pets, and/or any violations of this Agreement or rules contained herein and as then posted on rvselfpark.com. Guest understands that Park assumes no responsibility for personal injury, property damage, fines, or legal obligations which may be incurred during the use of the Park or the parking space.   

E. Chargebacks. Guest understands and agrees that in the event Guest initiates a chargeback and/or merchant dispute with their issuing bank regarding any payments(s) to Park, if the dispute is resolved in favor of Park (i.e. the payments are not reversed), Guest shall pay to Park a reasonable administrative fee in the amount of $100 or an amount equal to the amount in dispute, which shall be decided by Park at Park’s sole discretion. Such fee will be invoiced via PayPal to the email addressed used by Guest during the reservation process.

3. This Agreement Does Not Create A Tenancy. Guest and Park agree that: (a) Park shall have the right through its agents at all times to enter any parking site the Guest utilizes and occupies for purposes of, without limitation, maintenance, repair, provision of security, and for any other lawful purpose and (b) that this Agreement does not create a landlord-tenant relationship between Park and Guest, but instead creates an Innkeeper-Guest relationship.

4. Miscellaneous.  

a) If any provision of this agreement is found to be invalid or unenforceable in any applicable jurisdiction all other provisions herein shall remain in full force and effect in such jurisdiction and shall be liberally construed to effectuate the purpose and intent of this agreement.

b) Invalidity or unenforceability of any provision of this agreement in any jurisdiction shall not affect the validity or enforceability of any such provision in any other jurisdiction. 

c) This agreement shall be governed by and construed and enforced in accordance with the laws of the State where the applicable Park is located without regard to its choice of law principles. Venue of any lawsuit relating to this Agreement or Park shall exclusively lie in the Circuit Court of Crawford County, State of Missouri. 

d) Park shall be entitled to recover from Guests and all Co-Guests all attorney’s fees, pursuant to any claim for costs and litigation expenses it incurs in obtaining redress for Park’s injuries and damages resulting from any cause brought against Guest, or Co-Guest, for breach of obligations contained in this Agreement.
